VA FOR VO TERMS OF SERVICE
- The Service
Use of the VA for VO Voiceover Adjacent Business Resources (“Service”) by a voice over artist (Hereinafter “VO”) or “Voiceover Adjacent Resource” (Hereinafter “VA” as defined below) who posts his or her resume on the Site (hereinafter, “Participants”) is subject to all applicable VA for VO best-practice guidelines, policies and other terms and conditions made available to Participants, including through the Site, on the subscription or plan purchase page, any or all of which may be modified at any time. Purchasing additional subscriptions or plans, or modifying subscriptions or plans may reset the monthly billing date for subscriptions or plans associated with your account, resulting in pro rata charges to account for the new date. You shall not use any information obtained from the Site except for internal use in selecting and contacting Participants, through VA for VO, for purposes of filling your Voiceover Adjacent Resource requirements. You shall not use the VA for VO Service for any directly or indirectly illegal, discriminatory, or fraudulent purpose. VOs are solely responsible for their use of the Service, including but not limited to, how they search for VAs, who they decide to contact, and any related decisions they make regarding engaging that VA, or what if any tasks to assign to them. VA for VO Voiceover Adjacent Business Resources reserves the right to alter these Terms of Service at any time.
“Voiceover Adjacent Resource” provides services and/or resources to Voiceover Artists in any number of areas, including but not limited to, virtual assistance, lead generation, social media, audio editing, copywriting, or any other area that VA for VO may decide to offer in the future, which is designed to enhance the VO Artist’s productivity.
Contact information provided by VA for VO, including any phone numbers or email address, is for VOs individual use only and may not be shared with any other person. You are expressly forbidden from using any product or system intended to extract the information concerning a VA listed on this site, in order to circumvent the online system. Use of such system will result in your immediate termination from the Service. In addition, VA for VO may send emails to VAs on your behalf indicating that your Listing is potentially a match for the VOs requirements. In some circumstances, VA for VO may limit the number and/or frequency of times you may contact a VA through the Site. For example, if you contact a VA, and the VA does not express interest or contact you back, you may not be able to contact them again for a period of time.
IMPORTANT NOTICE: YOU EXPRESSLY AGREE THAT: in purchasing or obtaining access to the Service, you are paying VA for VO the amount indicated on the Site for access to educational materials as well as for the purpose of VA for VO facilitating the VO’s contact with a VA by sending a message to the email address that the relevant VA has provided to VA for VO, or by connecting them via phone call to the number provided by the VA. Your use of the Service is subject to all VA for VO Site Rules and policies, including the VA for VO Privacy Policy and any policies pertaining to VO for VA Services. VA for VO does not guarantee that the email address is still in use, that such message will be received, that such message will be read, that such message will be acted upon by any potential VA, or that any VA’s resume or information thereof is valid, accurate or complete in any respect. VA for VO may return different results for the same search query and has full discretion with respect to the VA profiles it presents in response to any particular search. VA for VO does not allow its Service, including but not limited to, VA contact service to be used in a spam like manner, and you expressly agree not to use the Service in such manner. VA for VO defines “spam like manner” as sending requests for positions to persons who are, as indicated by VA for VO experience and/or VAs behavior and reaction, unsuited for the role or who have indicated that such requests are unwanted. VA for VO reserves the right to disable VA for VO Search contact service for any user who, in VA for VO’s sole discretion, violates these terms of service, including the foregoing term. We reserve the right to drop any message, including without limitation dropping any message with an .ade, .adp, .bat, .chm, .cmd, .com, .cpl, .exe, .hta, .ins, .isp, .jar, .jse, .lib, .so, .dll, .lnk, .mde, .msc, .msp, .mst, .pif, .scr, .sct, .shb, .sys, .vb, .vbe, .vbs, .vxd, .wsc, .wsf, .wsh, or .zip attachment or any other attachment containing scripts, macros, or other code, or other messages that VA for VO suspects to be malicious or spam, or for any or no reason. The only acceptable use of this site is for access to educational materials provided by VA for VO or for VOs to be connected with potential VAs regarding a task request or potential assignment of a task. No other uses of the site are permitted. Scraping the VA for VO Voiceover Adjacent Business Resource website, which may include any VA profile or resume, or using the VA for VO Voiceover Adjacent Business Resource database for any other purpose except as allowed will result in legal action being taken against you. We may in our sole discretion place limits on your ability to run searches using Search or access educational materials if we suspect that your use may adversely affect VA for VO’s system, you are using the Search in a malicious or objectionable manner, or you have violated this Agreement. Additionally, if you are a competitor of VA for VO (including but not limited to any job aggregation website or any job posting websites) you may not use the VA for VO Voiceover Adjacent Business Resource website to contact a VA for the purpose of sending them an offer from your clients, and any such competitive use of the VA for VO Adjacent Business Resource database may result in VA for VO blocking you from the Site, blocking you from contacting Participants, and blocking your contact emails to those Participants without notice and you consent to the same. VA for VO may limit the number of devices each account is logged into. Each subscription or plan is solely for the individual use of the person to whom it is assigned, and may not be shared with other users.
In the event phone numbers are provided by the VA in the resume, VA for VO does not guarantee their validity and can not confirm whether such numbers are landlines or cell phones. You agree to call VAs regarding relevant task opportunities only. It is your sole responsibility to comply with all TCPA guidelines, as well as other laws against automated telephone dialing systems or laws governing phone or mobile communications in your applicable jurisdiction.
Information contained in VAs resumes is self-reported by VAs, may be outdated or inaccurate, and is not verified by VA for VO. Any filtering, sorting, matching, or ranking tools available to you as part of the Search Service rely on the VAs provided information and/or information you provide to VA for VO about your task requirements or preferences. The appearance of a given VAs’s profile in search results or as a match is not a guarantee that the VAs has the attributes or experience you have selected or that they would be interested in a job. When you use the Service, VA for VO does not guarantee that you will see desirable, or any, search results in response to each query or that you will see desirable, or any, daily matches. You are solely responsible for determining or verifying any VAs provided information, including whether a VAs has a certain license, certification, or security clearance.
You agree that VA for VO may update, modify, or discontinue the Search Service at any time and in our sole discretion and without liability to you. You agree and acknowledge that the Service pricing and offerings are subject to change.
- Cancellation
Once you have requested that VA for VO facilitate a connection with a VA, you may not revoke such request. Cancellation of your use of the Service shall be in accordance with any cancellation policies listed on the Site.
VA for VO reserves the right to cancel any subscription at any time and for any or no reason. VA for VO may immediately cancel the Service or these Terms at any time upon notice. VA for VO may modify the Service or these Terms at any time without liability and your use of the Service after notice that the Service or these Terms have changed indicates acceptance of the updated Terms. Sections 1, 3, 4, 5 and 6 will survive any expiration or termination of these Terms.
- Your Information
You represent and warrant that all information you provide to VA for VO is correct and current. You represent to VA for VO that you are a VO Artist interested in considering the VA as a potential contractor or a potential contractor willing to be connected with VOs looking for services.
- Disclaimer and Limitation of Liability
VA FOR VO’S PROVISION OF THE SERVICE AND THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WITH RESPECT TO THE SERVICE AND YOUR USE THEREOF, VA FOR VO AND ITS AFFILIATES, AND ITS AND THEIR THIRD-PARTY LICENSORS, EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY THAT ANY EMAIL ADDRESS THAT HAS BEEN PROVIDED TO VA FOR VO IS VALID, THAT ANY EMAIL SENT BY VA FOR VO AT YOUR REQUEST WILL REACH THE INTENDED RECIPIENT, THAT ANY INTENDED RECIPIENT OF ANY SUCH EMAIL WILL READ SUCH EMAIL, OR THAT ANY SUCH INTENDED RECIPIENT WILL ACT UPON SUCH EMAIL. FURTHER, VA FOR VO AND ITS AFFILIATES, AND ITS AND THEIR THIRD-PARTY LICENSORS, EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY THAT ANY RESUME IS AVAILABLE OR VIEWABLE AT ANY PARTICULAR TIME, OR THAT ANY RESUME DESCRIBES AN APPLICANT’S SKILLS, QUALIFICATIONS, OR ABILITIES. VA FOR VO AND ITS AFFILIATES, AND ITS AND THEIR THIRD-PARTY LICENSORS, EXPRESSLY DISCLAIM ALL OTHER WARRANTIES INCLUDING WITHOUT LIMITATION FOR NON-INFRINGEMENT, TITLE, SERVICE QUALITY, MERCHANTABILITY, AND FITNESS FOR ANY PURPOSE. YOU USE VA FOR VO, THE SITE, AND THE SERVICE AT YOUR OWN RISK. VA FOR VO DOES NOT GUARANTEE THAT THE SITE OR SERVICE WILL ALWAYS BE ERROR FREE, SAFE, OR SECURE.
EXCEPT FOR AMOUNTS PAYABLE PURSUANT TO SECTION 6 HEREUNDER AND FOR ANY BREACH BY YOU OF SECTION 1, TO THE FULLEST EXTENT PERMITTED BY LAW: (a) NEITHER PARTY WILL BE LIABLE UNDER THESE TERMS FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES WHETHER IN CONTRACT, TORT OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY; AND (b) EACH PARTY’S AGGREGATE LIABILITY TO THE OTHER UNDER THESE TERMS IS LIMITED TO AMOUNTS PAID OR PAYABLE TO VA FOR VO BY YOU FOR THE VA FOR VO RESUME SEARCH SERVICE GIVING RISE TO THE CLAIM.

- No Guarantee of obtaining work
Participants agree and acknowledge that use of this website does not guarantee any work or minimum fee to be paid to Participants and that any and all work obtained on this website will not be from VA for VO, but rather by Participants registered on the website who are seeking services of other registered Participants.
- Payment
You shall be charged if, and as, indicated by the Site. Upon your request, VA for VO may in its sole discretion pause your subscription or membership plan and associated cost, and upon VA for VO unpausing the subscription or plan, it will continue for the remaining term until it expires and/or automatically renews. Details regarding the membership plan are available on the Site. If your billing address is in the United States, you shall pay all charges in US Dollars. Charges are exclusive of taxes, including VAT. You are responsible for all taxes as applicable and appropriate. You are responsible for paying (y) all taxes and government charges, and (z) reasonable expenses and attorney fees VA for VO incurs collecting late amounts. You waive all claims relating to charges unless claimed within 60 days after the charge (this does not affect your credit card issuer rights). PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODIC ALLOTMENTS UNDER THE APPLICABLE MEMBERSHIP SUBSCRIPTION OR PLAN. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period. Refunds (if any) are at the absolute discretion of VA for VO and only in the form of credit for VA for VO services. You acknowledge and agree that any credit card and related billing and payment information that you provide to VA for VO may be shared by VA for VO with companies who work on VA for VO’s behalf, such as payment processors and/or credit agencies, solely for the purposes of checking credit, effecting payment to VA for VO and servicing your account. VA for VO may also provide information in response to valid legal process, such as subpoenas, search warrants and court orders, or to establish or exercise its legal rights or defend against legal claims. VA for VO shall not be liable for any use or disclosure of such information by such third parties. All withholding tax remittances to the government are your sole responsibility and VA for VO shall have no liability whatsoever therefore. Invoices may be provided to you via electronic mail, unless otherwise specified by VA for VO. If you purchase a subscription or plan, you acknowledge and agree that your subscription or plan will automatically renew and VA for VO will charge you on a recurring basis until you cancel your subscription or plan and such cancellation goes into effect, which may not be until the next billing cycle. Pausing your subscription or plan does not cancel it. Your subscription will continue to automatically renew after being unpaused. The applicable billing cycle (e.g. monthly or annual, etc.) will depend upon the terms agreed upon.
- Indemnification
You shall indemnify, defend and hold harmless VA for VO, its agents, affiliates, and licensors from any third-party claim or liability (including without limitation reasonable legal fees) arising out of your use of the VA for VO Resume Search Service, including but not limited to, how you conduct the search, any contact you have with the recipient (or intended recipient), any email you request to be sent pursuant to these Terms, any phone call or text message you make to a recipient, and activities of any third party service provider you engage to facilitate your sourcing activities through the VA for VO Resume Search Service, such as an Applicant Tracking System.
